1. Acceptance of Terms
By downloading, installing, or using the Spree mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Spree ("we," "us," or "our").
2. Description of Service
Spree is a personal shopping decision-making application that allows users to:
- Import and save product links from third-party websites and online stores
- Organize saved products into custom collections
- Use swipe-based interactions to rank and prioritize saved products
- Access AI-powered virtual try-on features (available to Pro subscribers)
- Manage personal wishlists and purchasing decisions
Spree is not a retailer, marketplace, or purchasing agent. We do not facilitate, process, or guarantee any purchases. All transactions occur directly between you and third-party retailers.
3. Eligibility and Accounts
You must be at least 13 years old to use Spree. If you are under 18, your parent or guardian must review and agree to these Terms on your behalf. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
Authentication is provided through Apple Sign-In. By using this authentication method, you also agree to Apple's terms of service. We do not store your Apple ID credentials.
4. Subscriptions and Payments
Spree offers a free tier and a paid subscription ("Spree Pro") with the following terms:
- Free Plan: Limited to 3 collections and 50 products per collection. No virtual try-on credits included.
- Spree Pro — Monthly: $4.99 USD per month, billed monthly.
- Spree Pro — Annual: $39.99 USD per year, billed annually (saves approximately 33%).
All subscriptions are processed through Apple's App Store and are subject to Apple's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. To cancel, navigate to iOS Settings → Apple ID → Subscriptions and cancel the Spree subscription.
We do not issue refunds except as required by applicable law or Apple's refund policy. Prices are listed in USD and may vary by region due to local taxes and currency conversion. We reserve the right to change pricing with at least 30 days' advance notice to active subscribers.
5. User Content and Uploaded Photos
For the AI virtual try-on feature, you may upload photographs of yourself ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, non-transferable license to process these images solely for the purpose of generating try-on output for your personal use.
- You retain full ownership of any photos you upload.
- We do not use your photos to train AI models without your explicit, opt-in consent.
- User Content is stored securely and is not shared with third parties except as strictly necessary to operate the service (e.g., AI inference processing).
- You may delete your uploaded photos at any time from within the app, or by deleting your account.
You represent and warrant that you have the right to upload any content you submit and that doing so does not infringe the rights of any third party.
6. Third-Party Content and Links
Spree allows you to import product information from third-party websites. We are not responsible for the accuracy, availability, legality, or content of any third-party websites or products. Product information (titles, prices, images) is extracted automatically and may become outdated or inaccurate after import. Always verify current pricing and availability directly on the retailer's website before making a purchase.
Spree is not affiliated with, sponsored by, or endorsed by any third-party retailer or brand whose products may appear within the app.
7. Privacy
Your privacy is important to us. Our Privacy Policy governs how we collect, use, and protect your information. Key commitments:
- We do not sell your personal data to any third party.
- We do not display advertising within the app.
- We use your data solely to provide and improve the Spree service.
- You can request complete deletion of your account and all associated data at any time through the app's Profile tab.
8. Intellectual Property
The Spree application — including its design, source code, branding, and all content created by us — is owned by Spree and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sublicense, or create derivative works based on our intellectual property without our prior written permission.
Product names, brand names, trademarks, and images imported into the app remain the exclusive intellectual property of their respective owners. Spree asserts no ownership over third-party content.
9. Prohibited Conduct
You agree not to use the App to:
- Violate any applicable local, state, national, or international law or regulation
- Attempt to reverse-engineer, decompile, disassemble, or derive source code from the App
- Use automated scripts, bots, or tools to scrape or extract data from the App
- Upload User Content that is illegal, harmful, defamatory, or infringes third-party rights
- Attempt to gain unauthorized access to our systems or any other user's account
- Impersonate any person, entity, or organization
- Interfere with or disrupt the integrity or performance of the App or its servers
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components. We do not guarantee the accuracy, completeness, or timeliness of product information imported from third-party websites.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPREE AND ITS FOUNDERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO SPREE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).
12. Indemnification
You agree to defend, indemnify, and hold harmless Spree and its team from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or relating to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately. You may delete your own account at any time through the Profile tab. Provisions that by their nature should survive termination (including disclaimers and limitations of liability) will survive.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the App shall first be subject to informal resolution by contacting us at the email below. If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. Your continued use of the App after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App and may cancel your subscription per Section 4.
16. Apple App Store — Additional Terms
If you downloaded the App from the Apple App Store, these additional terms apply:
- These Terms are solely between you and Spree. Apple Inc. is not a party to these Terms.
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any third-party intellectual property infringement claim related to the App, Apple bears no responsibility for the investigation, defense, settlement, or discharge of such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you.
